 The House Transportation Committee was called to order by Chairman            
 Gary Davis at 1:00 p.m.  Members present at the call to order were            
 Representatives Davis, Masek, James, Brice, Sanders, MacLean, and             
 Williams.                                                                     
 HTRA - 02/08/95                                                               
 HB 21 - DRIVERS LIC REVOCATION; ALCOHOL/DRUGS                               
                                                                               
 CHAIRMAN GARY DAVIS indicated there was a proposed committee                  
 substitute for HB 21.

 REPRESENTATIVE TOM BRICE made a motion to adopt the proposed CS.

 REPRESENTATIVE CYNTHIA TOOHEY, Co-Sponsor, stated that HB 21 is               
 jointly sponsored by herself and Representative Porter.  She stated           
 the bill "fixes a loophole" in  HB 299, which was passed last year.           
 Representative Toohey explained that under HB 299, the                        
 administrative license revocation can only occur when there has               
 been a violation of the pertinent state law.  She further explained           
 that HB 21 simply amends the bill to include violations that are              
 under municipal ordinance.  She added that HB 21 has three zero               
 fiscal notes and is supported by the Department of Public Safety.             
 Representative Toohey said that  Anchorage's acting municipal                 
 prosecutor, is on line and ready to respond to any questions, if              
 necessary.  Representative Toohey addressed the Committee                     
 Substitute.  She explained that the intent of the CS was to delete            
 from line 9, of Section 1.  AS 28.15.183(a) of the original bill,             
 "AS 11.71 or in violation of a municipal ordinance with                       
 substantially similar elements."  The CS was designed to eliminate            
 the above with the exception of "or a municipal ordinance."  She              
 stated that the bill is basically a "housekeeping bill."  It has              
 been successful in Anchorage over the past year and said she would            
 appreciate any support.

 CHAIRMAN DAVIS reiterated additional benefits to the proposed CS.             
 Chairman Davis added that after being a municipal official in the             
 past, he agreed that benefits a municipality by enabling them to              
 draft their own rules and regulations.  He also added it will cut             
 down on court cost on the state level.                                        
                                                                               
 CHAIRMAN DAVIS indicated that the CS had been adopted.  Hearing no            
 objection, the motion carried.

 REPRESENTATIVE JEANNETTE JAMES made a motion to pass CSHB 21(TRA),            
 out of committee with individual recommendations, and with the                
 attached zero fiscal notes.

 CHAIRMAN DAVIS asked if there was any objection.  There being none,           
 CSHB 21(TRA) was moved out of the House Transportation Committee.
